A court in the Kostanay region has ordered a daughter to pay monthly alimony to her mother, who is a Group II disabled person. The daughter refused to help, claiming her mother had previously abused alcohol and failed to fulfill parental duties, reports Todayinfo news agency.
According to case materials, the plaintiff argued she needed financial support for treatment, food, and utilities, as her disability benefits did not cover expenses. The defendant disagreed. The daughter accused her mother of neglecting parental responsibilities and abusing alcohol, resulting in her being raised by relatives.
However, the judge cited Article 145 of the Code of the Republic of Kazakhstan 'On Marriage (Matrimony) and Family', which obliges adult able-bodied children to support their disabled parents.
'The court considered the plaintiff's serious illnesses confirmed by medical documents, her need for outside help, and the small amount of benefits. The court also took into account the defendant's income and age,' the court statement said.
Initially, the woman demanded 40 MCI (147,000 tenge), but the court partially granted the claim and ordered the defendant to pay 4 MCI (15,700 tenge) monthly. The decision has entered into legal force.
