A scandal worth hundreds of millions of tenge erupted in Almaty. Due to a conflict between two companies, about 500 livestock died. A farmer had signed a contract with a limited liability company that was supposed to transfer money for animal care, but payments stopped at some point. Cows had to be saved at his own expense. The case is now being heard in court, with details by Zhazira Mukash, reports Todayinfo.kz. Two companies signed a contract four years ago. The limited liability company was to supply the farmer with livestock and feed. But according to the director of the agricultural enterprise, Galymzhan Zhunusbekov, at some point the entrepreneur stopped transferring funds, the debt began to grow, and the situation got out of control. GALYMZHAN ZHUNUSBEKOV, DIRECTOR OF BAYSERKE-AGRO LLP:
In 2022, Bayserke LLP entered into a number of contracts with Meat Processing and Service. In 2023, they virtually stopped making any payments, and we maintained this livestock at our own expense.
At the same time, another problem develops: irregular care leads to mass death of animals. According to farmers, about 500 livestock died, almost a third of the herd. The carcasses, the farm claims, remained in the pens, creating a sanitary threat. And total expenses rose to 500 million. In spring 2023, the farm went to court and won. However, two years later, the other party filed a new lawsuit, seeking to cancel previously issued rulings of private bailiffs. GALYMZHAN ZHUNUSBEKOV, DIRECTOR OF BAYSERKE-AGRO LLP:
By this, they want to cancel the ruling of the private bailiff, which two years ago decided to reimburse us 380 million tenge. Although our costs now total 573 million.
KAMBAR YUSUPOV, LAWYER OF MEAT PROCESSING AND SERVICE LLP:
The debt amount was just over 102 million tenge. During enforcement proceedings, the bailiff issued four rulings on recovery of enforcement expenses. Another 475 million tenge was added to this 102 million. Currently, we have filed a motion to restore the missed deadline for valid reasons.
The case is now being re-examined in court. Its decision will determine whether the previously issued rulings, which recover the costs of livestock maintenance, remain in force or are canceled, leading to a revision of the entire amount of charges.
