In Almaty, LGBT activist Amir Shaikenjanov was accused of raping his subordinate under aggravating circumstances and threatening HIV infection.
The Medeu District Court of Almaty heard the criminal case against Amir Shaikenjanov behind closed doors under Articles 120 part 1 and 118 part 1 of the Criminal Code of Kazakhstan (rape using the victim's helpless state, intentional exposure of another person to risk of HIV infection).
The court established that in March 2025, he acted intentionally, offering his employee an unknown substance affecting psychophysiological state, thereby rendering him helpless. Taking advantage of this and the lack of voluntary consent, he engaged in sexual intercourse with the victim against his will.
It was also noted that Amir Shaikenjanov, knowing he had the human immunodeficiency virus (HIV), had sexual intercourse with the victim, exposing him to the risk of infection.
The defendant's guilt was confirmed by evidence collected in the case, the victim's testimony, and a video recording.
"The defendant Amir Shaikenjanov did not plead guilty. The victim requested a custodial sentence. The prosecutor requested a sentence of 5 years and 4 months of imprisonment for the totality of criminal offenses. No mitigating or aggravating circumstances were established. Amir Shaikenjanov was found guilty of the charges. Under Part 1 of Article 118 of the Criminal Code (criminal misdemeanor), he was released from liability due to the expiration of the statute of limitations," the Almaty courts reported.
Under Part 1 of Article 120 of the Criminal Code (grave crime), Amir Shaikenjanov was sentenced to 5 years of imprisonment.
